CPAW and I4AW Call on NLRB to Reverse Biden-Era Policies That Strip American Workers of Choice and Due Process
WASHINGTON, D.C. — The Coalition to Protect American Workers (CPAW) and the Institute for the American Worker (I4AW) today sent a joint letter to NLRB General Counsel Crystal Carey urging swift action to reverse Biden-era labor policies that erode worker choice, restrict employer free speech, and weaponize procedural tools to block workers from voting on their own representation.
The letter urges General Counsel Carey to prioritize three reforms: cementing secret-ballot elections as the foundation of representation decisions; restoring Employer Meetings on Unionization so workers hear both sides before they vote; and ending blocking charges that freeze elections while investigations proceed.
"The Biden NLRB wasn't a neutral arbiter; it was a political weapon wielded on behalf of union leadership and the Democratic Party at the direct expense of American workers," said Gene Hamilton, Senior Advisor to CPAW. "They gutted secret-ballot elections, silenced employers, and handed union leadership a procedural playbook to override worker votes. President Trump has made clear that his administration stands with workers, not union political machines, and General Counsel Carey is already moving in that direction. We're proud to support her efforts and encourage the Board to continue the work with the clear guidance and rulemaking American workers deserve to ensure the Biden era damage is fully reversed."
"American workers deserve a choice and a voice on unionization," said Vincent Vernuccio, President and Co-Founder of the Institute for the American Worker. "Yet under the last administration, the NLRB issued case decisions and rules that undermined workers, from allowing union organizers to have monopoly bargaining rights even if workers voted against it to allowing them to slow-walk elections the moment workers try to leave. We look forward to assisting General Counsel Carey and the new members of the Board to level the playing field for American workers."
CPAW and I4AW welcome General Counsel Carey's early actions, including GC Memos 26-02 and 26-03, as meaningful departures from her predecessor's lopsided agenda. The organizations are calling on the Board to build on that foundation with formal guidance and rulemaking that permanently restores worker choice, due process, and stability to federal labor policy.
